Lincoln Police were called to a hospital around 6:24 p.m. Thursday night after getting a report of a assault victim seeking treatment. Officers spoke with a 26 year old man who said he went to a home in the 3800 block of North 1st Street to pick up his child from the mother. While speaking with the child’s mother, another resident, 28 year old Caleb Rutherford confronted the victim.
The man told Rutherford he was having a private conversation with the child’s mother. Rutherford became upset and punched the victim in the side of the face several times. That caused the man to fall backwards onto his wrist. Rutherford continued to punch the man several times while on the ground. The man then went to a hospital for treatment for a broke wrist, a swollen right eye and a cut to the lower lip that required reconstructive surgery.
Officers located Rutherford at the home on 1st Street. After speaking with the victim, witnesses, Rutherford and collecting evidence, Rutherford was booked for 1st Degree Assault. It is a felony charge due to the extent of injuries to the victim.
