A Georgia man has been indicted on federal charges after allegedly leaving violent voicemail threats for U.S. Senators Ted Cruz of Texas and Deb Fischer of Nebraska.

Robert Davis Forney, 25, of Duluth, was arraigned Monday in federal court on charges of communicating threats in interstate commerce. The indictment was handed down June 10 by a federal grand jury in the Northern District of Georgia.

According to prosecutors, Forney called Sen. Cruz’s office twice on Jan. 9, 2025, and left voicemails threatening sexual violence against the senator and his family. The following day, he allegedly left a similar threat on Sen. Fischer’s office voicemail.

“Threatening our elected officials and their families is an act of violence that undermines our entire democracy,” said U.S. Attorney Theodore Hertzberg.

FBI officials say the investigation remains ongoing. Forney is presumed innocent until proven guilty in court.
