Nebraska Attorney General Mike Hilgers has joined attorneys general from 48 states and territories in announcing a nearly $30 million settlement with generic drug manufacturer Glenmark over allegations the company conspired to inflate prescription drug prices.

The $29.6 million settlement resolves claims that Glenmark participated in a long-running scheme to artificially raise prices, reduce competition, and restrain trade involving numerous generic prescription medications. Nebraska will receive just over $128,000 as part of the agreement.

As part of the settlement, Glenmark has agreed to cooperate in the ongoing multistate lawsuit against dozens of drug companies and executives and implement internal reforms designed to strengthen compliance with antitrust laws and promote fair competition.

The agreement follows earlier settlements with Lannett, Bausch, Apotex, and Heritage, bringing total settlements in the nationwide investigation to nearly $67 million. State investigators allege competing drug manufacturers coordinated prices through private meetings, phone calls, emails, and text messages while discouraging competition.

The investigation is based on evidence that includes millions of documents, phone records, and information provided by cooperating witnesses. The first trial in the multistate litigation is expected to begin in Connecticut later this year.

Consumers who purchased generic prescription drugs manufactured by Glenmark, Lannett, Bausch, Apotex, or Heritage between May 2009 and December 2019 may be eligible for compensation through the ongoing settlement process.
