A former Lincoln restaurant owner is facing federal charges for failing to turn over payroll taxes to the IRS.

55-year-old Brett Richardson of Lincoln, the past owner of the now-closed ‘9 South CharGrill’ on 9th and South Street, faces 10 counts of willful failure to pay quarterly taxes to the Internal Revenue Service (IRS) throughout the years 2018 to 2021.

The indictment shows Richardson collected $161,817.84 in Medicare, income, and Social Security taxes from his employees and never turned it over to the IRS as is legally required.

U.S. Attorney Susan Lehr says Richardson’s maximum possible penalty if convicted is up to 5 years’ imprisonment, a $250,000 fine, a 3-year term of supervised release, and a $100 special assessment on all counts

The popular and long standing bar & grill suddenly closed, without reason, in August of 2023. It originally opened in 2008, and was in business for about 15 years.
