Nebraska Supreme Court To Hear Challenge To Abortion Ban

The Nebraska Supreme Court will hear arguments Tuesday morning in a lawsuit that seeks to overturn the state’s 12-week abortion ban and restrictions on care for transgender youth. Last year Nebraska lawmakers passed LB574, which bans gender-affirming care for minors and abortion after 12 weeks’ gestation.

ACLU of Nebraska argues the legislature violated the ‘single subject’ clause in passing the abortion restrictions.   Last August a District Court Judge rejected the lawsuit filed by Planned Parenthood and sided with Attorney General Mike Hilgers in his argument that all regulations within the bill fell under the category of health care.

Tuesday’s hearing is for an appeal of that Lancaster County District Court ruling.  Planned Parenthood of the Heartland v. Hilgers will go before the Nebraska Supreme Court at 9 a.m.

The court opinion will likely come several weeks or months after the hearing.
