A Waverly, Nebraska man was sentenced in federal court to 5 years probation, 12 weekends of intermittent confinement, $272,202 in restitution, and a $100 special assessment for theft of government funds.
The cases stared in November, 2017 when the Social Security Administration received a tip that 45 year old James Nieman was collecting social security disability payments stating he did not work due to disability. It was later determined that he was a self-employed floor installer. Nieman received SSI and HHS Medicare benefits from November 2001 to March of 2019. During that time he voluntarily, intentionally and knowingly made misrepresentations regarding his employment and income to receive the benefits he was not entitled to.
Neiman received $226,737.70 in SSI benefits and $45,464.30 in HHS benefits he was not entitled to.
The case was investigated by the Office of the Inspector General for the Social Security Administration. There is no parole in the federal system.
