The Nebraska Department of Justice filed the third lawsuit Wednesday challenging the federal government’s recent attempts to mandate vaccinations for COVID-19. This filing seeks to stop the Biden Administration’s Centers for Medicare and Medicaid Services mandate that would impact healthcare workers in Nebraska and elsewhere.
As with the other two challenges, the Department of Justice argues this mandate exceeds the Biden Administration’s powers and violates the U.S. Constitution and other federal laws.
In preparing for this lawsuit, Nebraska spoke with many care facilities in Nebraska. The feedback was similar that the mandate will force healthcare providers to fire critical employees that include operations personnel who don’t provide patient care. That would have a devastating impact on many facilities in the state. That jeopardizes the ability of Nebraskans to receive necessary services.
The lawsuit asserts that state health officials and hospital administrators are in the best position to address appropriate COVID-19 regulations at care facilities.
The statement read, “We hope to avoid the detrimental impact that the mandate threatens to healthcare services in Nebraska.”
